On September 25, 1863 the First Brigade of Col. R.K. Byrd (Fourth Division, 23rd Corps) was attacked by Confederate forces at Calhoun, Tennessee. After a two-hour engagement Foster retreated to within 2 miles of Athens where he was joined by the First Kentucky Cavalry commanded by Col. Frank Wolford. Foster and Wolford attacked the Confederates the next day and later fell back to Philadelphia
